Most courts in Montana require that all parties to litigation engage in mandatory mediation. For those courts that do not, it is still highly encouraged. We know, for those of us representing clients in the legal system, that substantial time and costs can be avoided when parties participate in the mediation process.
Alternative Dispute Resolution ("ADR") refers to any means of settling disputes outside of the courtroom. ADR typically includes early neutral evaluation, negotiation, conciliation, mediation, and arbitration.
